Acceptance of Terms
By accessing or using the Earthly Delights Club platform at app.earthlydelights.club, operated by Big Heavy LLC (“Earthly Delights,” “we,” “us”), you agree to be bound by these terms. If you do not agree, please do not use our services.
Eligibility
You must be at least 18 years old to use our services. By creating an account or making a booking, you represent that you are at least 18 years of age and have the legal capacity to enter into these terms.
Services
Earthly Delights Club provides a platform for organizing and booking group travel experiences. Our services include trip listings, payment processing, itinerary management, real-time group messaging, and travel coordination tools. Access to specific trips requires registration and may require payment.
Bookings and Payments
Trip bookings are subject to availability and confirmation. By making a booking, you agree to the following:
- All payments are processed securely through Stripe via ACH bank transfer or credit/debit card
- Deposits are non-refundable unless otherwise stated in the trip agreement
- Full payment must be received by the deadline specified for each trip
- All amounts are in US dollars
- You are responsible for reviewing and signing the trip agreement before your booking is confirmed
Cancellation Policy
Cancellation terms are specified in each trip's individual agreement. Generally, deposits are non-refundable. Cancellations after full payment may be subject to partial refunds depending on timing and the ability to fill the vacated spot. Contact us directly for cancellation requests.
User Conduct
You agree to:
- Provide accurate personal information (passport details, emergency contacts, dietary needs)
- Use the messaging feature respectfully and in accordance with group norms
- Not share login credentials or attempt to access other users' accounts
- Comply with all applicable laws and travel regulations
Travel Risks
Travel involves inherent risks. Earthly Delights Club facilitates trip coordination but is not a travel agency or tour operator. We are not liable for flight delays, cancellations, lost luggage, illness, injury, or any other incidents that may occur during travel. We strongly recommend purchasing independent travel insurance.
Intellectual Property
All content, trademarks, and materials on our platform are the property of Big Heavy LLC unless otherwise noted. Photos shared through the platform remain the property of their original creators.
Limitation of Liability
Our services are provided “as is” without warranties of any kind. Big Heavy LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services, participation in trips, or reliance on information provided through the platform.
Account Termination
We reserve the right to suspend or terminate your account and access to our services at any time, with or without notice, for conduct that we determine violates these terms, is harmful to other users or the group experience, or is otherwise objectionable. If your account is terminated, any pending bookings may be cancelled subject to the cancellation policy.
Changes to These Terms
We may update these terms from time to time. When we make changes, we will update the effective date at the top of this page. For material changes, we will notify you by email. Your continued use of the platform after changes take effect constitutes acceptance of the updated terms.
Governing Law
These terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of the State of Florida.
